Estate agency director fined after damp and mould complaint

An estate agency director has been prosecuted and found guilty for failing to respond to a request for information around the management of a property in Hughenden Road.

Jason Adams of Riverstone-Abbey Estate Agents in Hastings – one of four offices owned by the agency – was requested to provide details in relation to the management of the property which was being investigated by the council following a complaint regarding damp and mould.

A Section 16 Notice under the Local Government (Miscellaneous Provisions) Act 1976 was served by Hastings Borough Council. Despite a reminder letter from the council, Adams did not respond, and he also failed to appear at court.

In his absence the Magistrates found him guilty, he was given a £2,640 fine, required to pay a £1,056 victim surcharge and costs to the council of £877.09.

Cllr Glenn Haffenden, lead councillor for housing and community wellbeing, said: “As an administration, we are keen to support our landlords and managing agents who provide a much-needed contribution to the private rented sector in the town. Making sure that all our residents have a good quality home to live in is one of the top priorities in our new corporate plan.

“Our team of officers will engage with landlords and managing agents where appropriate to achieve compliance. However, where this is not appropriate or engagement is not forthcoming, we will not hesitate to take proportionate enforcement action. This protects occupiers but also helps to support a level playing field for those who do comply with their duties and responsibilities.”
